General
By using this website (the "Site") and services (collectively with the Site, the "Services") offered by BountyLabs, Inc. (and its affiliates, agents, representatives, consultants, employees, officers, and directors—collectively, "Bounty," "we," or "us"), you are agreeing to these legally binding rules (the "Terms"). You're also agreeing to our Privacy Policy and Cookie Policy, and agreeing to follow any other rules on the Site, like our Community Guidelines and rules for funding projects.
We may change these terms from time to time. If we do, we'll inform you about any material changes, either by notifying you on the Site or by sending you an email. Users based in the European Union will be notified of material changes at least 15 days before they go into effect. New versions of the terms will never apply retroactively—we'll tell you the exact date they go into effect. If you continue using Bounty after a change, that means you accept the new terms. These terms may be translated into other languages for your convenience; however, in the event of a conflict between the English version and any translations, the English version shall prevail.
Bounty is designed for your personal and professional use in the realm of content creation and crowdfunding. This use is subject to the guidelines and limitations below.
Creating an Account
You can browse Bounty without registering for an account. However, to utilize some of Bounty's features, you will need to register, choose a username, and set a password. When you register, the information you provide must be accurate and complete. Do not impersonate anyone else or choose names that are offensive, infringe on intellectual property rights, or violate anyone's rights. We reserve the right to cancel your account if these rules are not followed.
You’re responsible for all activity on your account, and for keeping your password confidential. If you find out that anyone has used your account without your permission, you should report it to support@withbounty.com.
To sign up for an account, you need to be at least 18 years old, or old enough to form a binding contract where you live. If necessary, we may ask you for proof of age.
Usage Restrictions
We expect everyone using Bounty to contribute to maintaining a respectful and safe environment. Please refrain from engaging in any of the following activities on the Site:
- Abiding by the Law: Do not engage in any action that breaks the law, infringes or violates other people's rights, or breaches any contract or legal duty you owe to anyone.
- Honesty and Accuracy: Do not post false, misleading, or inaccurate information. Avoid deceptive or fraudulent activities.
- Respect for Others:: Do not offer any items or services that are illegal, violate any of Bounty’s policies, rules, or guidelines, or contravene any applicable laws, statutes, ordinances, or regulations.
- No Spam: Avoid distributing unsolicited or unauthorized advertisements, promotional materials, junk mail, spam, chain letters, or any other form of solicitation. Do not run unauthorized mailing lists or any form of auto-responder, or spam on or through the Site.
- Protecting Computer Systems: Do not distribute viruses or any other code, files, or programs designed to interrupt, damage, or limit the functionality of any software, hardware, or telecommunications equipment.
- Interference with Services: Do not attempt to interfere with the proper working of the Services, bypass security measures, or access unauthorized systems or data, whether belonging to Bounty or others.
- System Load: Avoid actions that place an unreasonable load on our infrastructure or our third-party providers. We reserve the right to determine what constitutes "unreasonable."
- No Unauthorized Crawling: Do not use any manual or automated means, including devices, software, or scripts, to "crawl" or "spider" any part of the Site.
- Respect Intellectual Property: Do not disassemble, reverse engineer, or otherwise attempt to discover the source code, underlying ideas, or algorithms of the Site or any part of Bounty, except to the extent that such activity is expressly permitted by applicable law.
How Bounties Work
- Nature of Bounties: Bounty is a platform that facilitates the crowdfunding of specific content by content creators ("Creators"). Users who fund these bounties ("Backers") are supporting a creative endeavor of their choosing. It's important to understand that by creating or funding a Bounty, no contractual relationship is formed between Creators and Backers, nor between either party and BountyLabs, Inc.
- No Contractual Obligation: Backers understand that their contribution to a Bounty is a support to a creative process, not an exchange for a guaranteed product. Creators are encouraged to fulfill their proposed content, but there is no legal obligation for them to do so. Similarly, there is no contractual or implied contract between Creators and BountyLabs, Inc., or between Backers and BountyLabs, Inc.
- Creator's Responsibility: The Creator is solely responsible for defining the scope and nature of the Bounty and for honestly reporting the fulfillment of the Bounty. The Creator must provide clear and accurate descriptions of what they intend to accomplish and must communicate any changes or delays to the Backers.
- Bounty's Role: While Bounty may make efforts to assess whether a Creator has fulfilled their Bounty before releasing funds, Bounty makes no guarantees regarding the completion or quality of the Bounty. Bounty's role is limited to facilitating the crowdfunding process and providing a platform for Creators and Backers to connect.
- Release of Funds: Bounty may withhold the release of funds until it has made a reasonable effort to assess the fulfillment of the Bounty. However, the final release of funds to the Creator does not imply that Bounty confirms or guarantees that the Bounty has been fulfilled as per the description or expectations.
- Acknowledgment of Risk: Backers acknowledge that by funding a Bounty, they are supporting a creative effort and not entering into a purchase agreement. There is an inherent risk that a Bounty may not result in the proposed output, and Backers understand and agree to bear this risk.
Funding on Bounty
- Collection of Funds: When a user ("Backer") pledges to support a Bounty, the funds are collected at the time of their pledge. These funds are then held by Bounty until the Bounty is either fulfilled or deleted by its owner (the "Creator").
- Holding and Release of Funds: Funds pledged by Backers are held in a secure account managed by Bounty. These funds are only released to the Creator once the Bounty has been confirmed as fulfilled according to the assessment criteria established by Bounty. If a Bounty is deleted, the funds remain with Bounty to be refunded only at Bounty's discretion.
- Bounty Fees: Bounty will deduct a predetermined percentage as a service fee from the total funds collected for each Bounty. This fee is deducted prior to the disbursement of funds to the Creator upon the successful completion of a Bounty.
- No Refunds Policy: Bounty generally does not offer refunds to Backers. In cases where a Bounty is deleted, instead of a refund, Backers will have the option to allocate their pledged funds to support another Bounty on the platform.
- Reallocating Funds: If a Bounty is deleted, Backers will be notified and given the opportunity to redirect their funds to another Bounty of their choice. This redirection must be done within a specified timeframe, after which any unallocated funds may be subject to reallocation at Bounty's discretion.
- Responsibility for Taxes: Creators are responsible for any taxes due on the funds they receive. It is the Creator’s responsibility to understand and comply with any tax obligations that arise from receiving funds through Bounty.
- Acknowledgment of Terms: By backing a Bounty, Backers acknowledge and agree to these funding terms. Creators understand that their receipt of funds is contingent upon the fulfillment of their Bounty as per Bounty's assessment and minus the applicable fees.
Boundaries of Responsibility
Bounty is not liable for any damages or losses related to your use of the Services. We do not become involved in disputes between users (both Creators and Backers) or between users and any third party in relation to the use of the Services. Bounty does not oversee the performance, punctuality, or fulfillment of Bounties, nor do we endorse any content users submit to the Site.
By using the Services, you release Bounty from all claims, damages, and demands of every kind—whether known or unknown, suspected or unsuspected, disclosed or undisclosed—that arise out of or are in any way related to such disputes and the Services.
All content you access or engage with through the Services is at your own risk. You are solely responsible for any resulting damage or loss to any party as a result of your actions on the platform. This includes, but is not limited to, the selection of Bounties to back, the nature of the content you create or interact with, and any reliance on other users' representations or actions.
Bounty’s role is strictly limited to providing a platform for crowdfunding creative content. We do not guarantee the accuracy, completeness, or usefulness of any content provided, nor the ability of Creators to complete Bounties, or the ability of Backers to make payments.
Fees and Payments
Creating an account on Bounty is free. However, for each Bounty that is completed, Bounty collects a service fee, which is a percentage of the total funds raised. This fee percentage may be subject to change, and any changes will be communicated through our Site. Additionally, our payment processing partners collect their own fees for each transaction. These fees may vary slightly based on the location of the user.
Before any fees are collected, you will have the opportunity to review and accept them. We commit to transparency in our fee structure, and any changes to our fees will be announced on our Site in advance. It's important to note that payment processing fees are collected directly by our partners, who are separate entities, and Bounty is not responsible for their performance.
As a user of Bounty, whether as a Creator or a Backer, you are responsible for any additional fees or taxes associated with your use of our platform. This includes, but is not limited to, any applicable sales taxes, value-added taxes (VAT), or other governmental charges. It is your responsibility to understand and comply with all relevant tax laws and regulations as they pertain to your use of Bounty.
Other Sites
Bounty may feature links to other websites. For example, Creator profiles, bounty descriptions, and user comments may include links to external sites. When you access third-party websites through these links, you do so at your own risk. Bounty does not have control over, nor do we endorse, the content or practices of these external sites.
In facilitating financial transactions, Bounty partners with third-party companies for payment processing. When you contribute to a Bounty or create one, you are also agreeing to the terms of service of the payment processor. It's important to be aware that each payment processor is a separate company, and Bounty is not responsible for their operations or performance. As such, we encourage you to review the terms and policies of these third-party services to fully understand your rights and obligations.
Content Posted on Bounty
Bounty does not claim ownership of the content you submit to us (your "Content"). However, to perform our Services effectively, we require certain licenses from you. By submitting a bounty for review or creating a bounty on Bounty, you agree to the following terms:
- License to Use Content: You grant to Bounty, and others acting on our behalf, a worldwide, non-exclusive, perpetual, irrevocable, royalty-free, sublicensable, transferable right to use, exercise, commercialize, and exploit the copyright, publicity, trademark, and database rights with respect to your Content. Generally, we use this Content to promote bounty and showcase our community on the website.
- Modifications to Content: When we use your Content, we may make changes, such as editing, translating, reformatting, excerpting, deleting, or translating it. You grant us the right to perform these modifications.
- Copyright Compliance: You agree to only submit Content for which you hold the copyright, or for which you have obtained permission. Your Content should not contain third-party copyrighted material or material subject to other third-party proprietary rights unless you have the appropriate permissions or legal entitlement.
- Responsibility for Royalties and Licensing: You are responsible for paying all royalties and other amounts owed to any person or entity based on your Content, or on Bounty's hosting of that Content.
- No Violation of Rights: You assure that Bounty's use of your Content as contemplated by this agreement does not infringe or violate the rights of any third party, including privacy, publicity, copyright, contract rights, or any other intellectual property or proprietary rights.
- Your Responsibility for Content: You are solely responsible for all information you submit to the Site, whether publicly posted or privately transmitted.
- No Liability for Content Errors: Bounty will not be liable for any errors, omissions, or inaccuracies in any Content.
Bounty Intellectual Property
The services provided by Bounty are protected under various legal frameworks, including copyrights, trademarks, service marks, patents, trade secrets, and other rights and laws. By using Bounty, you agree to respect all copyright and other legal notices, information, and restrictions contained in any content accessed through the Site. Additionally, you agree not to change, translate, or create derivative works of the Service without proper authorization.
Bounty grants you a license to reproduce content from the Services for personal use only. This license applies to both Bounty’s own protected content and user-generated content on the Site. This license is worldwide, non-exclusive, non-sublicensable, and non-transferable. If you wish to use, reproduce, modify, distribute, or store any of this content for a commercial purpose, you must obtain prior written permission from either Bounty or the relevant copyright holder. In this context, a “commercial purpose” refers to any use, sale, license, rental, or other exploitation of content for commercial gain in any manner.
Copyright Issues and DMCA Compliance
Bounty adheres to the requirements laid out in the Digital Millennium Copyright Act (DMCA), which provides a framework for addressing allegations of copyright infringement. We are committed to complying with the DMCA and respond to notices of alleged infringement that meet the legal requirements and adhere to our Copyright Policy.
In accordance with the DMCA and our policy, we reserve the right to remove or disable access to content that is alleged to be infringing and to terminate accounts of repeat infringers. These actions are taken at our sole discretion and when deemed appropriate based on the circumstances.
Deleting Your Account
You have the right to terminate your account at any time by emailing support@withbounty.com. Upon account termination, we may retain certain information as required by law or for legitimate business purposes.
Please be aware that the termination of your account does not automatically negate or remove any rights or obligations that have arisen under this agreement prior to termination. This includes Bounty's rights regarding any content you have already submitted to the Site. For example, if you have any current or past bounties, deleting your account will not automatically remove those bounties from the Site.
All provisions of this agreement, particularly those intended to survive termination (such as content rights, dispute resolution, and warranty disclaimers), will remain in effect after your account is terminated.
Bounty's Rights
To maintain the health, integrity, and security of our system, and to ensure a safe and secure environment for creators and backers, Bounty reserves the following rights:
- Changes to the Site and Services: We may modify or discontinue any part of the Bounty Site or Services without notice or liability.
- User Eligibility and Account Management: We reserve the right to determine who is eligible to use Bounty. We may, in certain circumstances, impose restrictions or limitations on accounts, and in cases of significant or repeated violations of our Terms or any other rules on the Site, such as our Community Guidelines, we may cancel accounts or decline to offer our Services. Our eligibility criteria may change over time. If use of Bounty is prohibited by law in your jurisdiction, your right to access Bounty is revoked.
- Bounty and Pledge Management: We reserve the right to cancel any pledge to any bounty, at any time and for any reason. We also reserve the right to reject, cancel, interrupt, remove, or suspend any bounty at any time and for any reason.
- Compliance with Laws and Regulations: We may withhold funds as necessary to comply with applicable laws and regulations.
- Limitation of Liability: Bounty is not liable for any damages resulting from the aforementioned actions.
It is our general policy not to publicly comment on the reasons for these actions. However, in cases where restrictions are imposed on or access to any of our Services is limited for a verified account holder, or if we intend to cancel a verified account, we will inform the account holder of the reasons for this action and, where appropriate, how they can remedy any issues, unless we are prohibited from doing so by law or in the interest of safety. For account cancellations, we will provide the account holder with the reasons for this action at least 30 days in advance, unless the cancellation is due to reasons related to illicit or inappropriate content, safety concerns, counterfeiting, fraud, malware, spam, data breaches, other cybersecurity risks, or the suitability of goods or services for minors.
Warranty Disclaimer
Your use of Bounty's Services is entirely at your own risk. The Services are provided on an “as is” and “as available” basis, without any warranties of any kind, either express or implied.
Bounty explicitly disclaims all warranties and conditions of any kind, whether express or implied, including but not limited to warranties of merchantability, non-infringement, and fitness for a particular purpose, as well as any warranties arising from course of dealing, course of performance, or usage of trade. No advice or information, whether oral or written, obtained by you from Bounty or through the Services, will create any warranty not expressly stated herein.
Indemnification
If your actions result in legal action against Bounty, or if you breach any of the promises you make in this agreement, you agree to defend, indemnify, and hold Bounty, its affiliates, officers, directors, employees, and agents, harmless from all liabilities, claims, and expenses (including reasonable attorneys' fees and other legal costs) that arise from or relate to your use or misuse of Bounty. This includes, but is not limited to, your violation of this agreement, any user-generated content you post, your violation of any law or the rights of a third party, and any activity related to your account by you or any other person accessing the site using your account.
Bounty reserves the right to take over the exclusive defense of any claim for which we are entitled to indemnification under this clause. In such an event, you agree to provide all reasonable cooperation as requested by us.
By accepting these Terms of Use, you also consent to service of process for any legal action that may be brought against Bounty.
Liability Limitations
To the fullest extent permitted by law, Bounty, its directors, employees, partners, suppliers, or content providers shall not be liable for any indirect, incidental, punitive, consequential, special, or exemplary damages of any kind. This includes but is not limited to damages (i) resulting from your access to, use of, or inability to access or use the Services; (ii) for lost profits, data loss, or the cost of procurement of substitute goods or services; or (iii) due to the conduct or content of any third party on the Site.
In no event shall Bounty's liability for direct damages exceed the total amount of one hundred U.S. dollars ($100.00) in aggregate.
Remaining Terms of Use
These Terms, along with any other documents referenced herein, constitute the entire agreement between you and Bounty with respect to the Services. They supersede all prior or contemporaneous communications and proposals, whether oral, written, or electronic, between you and Bounty with respect to the Services and will govern our future relationship.
Should any provision of these Terms be found invalid or unenforceable under applicable law, such provision will be limited or eliminated to the minimum extent necessary so that the remainder of these Terms will continue to be in full force and effect and enforceable. The failure by either you or Bounty to exercise any right provided in these Terms shall not be deemed a waiver of any further rights hereunder.
These Terms are personal to you and are not assignable, transferable, or sublicensable by you except with Bounty's prior written consent. Bounty may assign, transfer, or delegate any of its rights and obligations under these Terms without consent. Bounty shall provide notice of such assignment, transfer, or delegation by email, written notice, or by conspicuously posting the notice on our Site.
